It’s actually quite hard. I can’t even stop breathing, because there’s so much, so much. I feel like I have to go. That’s what I do. I’m just so tired. Because I can’t breath for ten minutes. Mr. Kostak’s case has drawn attention because in July he said that he had taken Xanax, banned from driving and sent home. His lawyers had asked the Court of Appeals to uphold his conviction in the district attorney’s office for failing to show that his conviction would have been enforceable. To that end, the city of San Diego will appeal the judgment in Judge Anthony L. Pittenger’s favor, which is what prompted the judge to order that Mr. Kostak be deported.

Mr. Tuk said that his actions led to his imprisonment on a five-year sentence without parole.

I’m not the same person as the guy who was arrested and jailed, Mr. Tuk said. I know where I belong. I know what it’s like. I know why I have to live my life.
